cheg - you ask a good question, what is an appropriate punishment?

One of the protestors, Hallam, the head of JSO, wasn't at and didn't participate in the protest. So - if we sat here discussing a protest to block the M25, and several fetchies went and did it for five days at our urging - should we go to jail? And I really, really don't think we should, in any circumstances.

Hallam chose to represent himself, and - as someone who broadly agrees with many of his points - he did himself absolutely no favours whatsoever - the judge was clearly deeply pissed off his conduct in court and threw the book at him. But the you see Trump regularly baiting judges and getting away with it.

You also have to wonder was this a deliberate end point, to "martyr" themselves to increase the sentences to such a point it arouses public sympathy or brings them to the public eye? Hallam seemed to go out of his way to provoke the judge.

I think suspended sentences would have been far more appropriate.

I mean currently, you could get in a car drive through a red light, while inhaling nitrous oxide, kill a woman and get less time than they did.

Someone plans a terrorist attack, they shouldn’t go to jail because they weren’t there? Same for a jailbreak or a robbery. Not sure that works. Hallam was the chief planner and organiser of the action they took right?

"Conspiracy to..." and similar inchoate offences can carry a higher tariff sentence because they evidence intent and forethought which isn't always as easy to show compared to the simple acts.

I think the balance of sanction Vs protest events is currently wrong and 5 years is self evidently too high a sentence for these offences, especially when compared with some of the dangerous driving offences etc, but all the judge can do is follow the law and the sentencing guidelines. The issue is that the law is OTT.
